New Labour Law
All though the new labour has NOT been approved and published, here is some of the new laws that has been considered. There are certain points that require clarifications, this is just an extract from Kuwait Times
CR = Current NW = New
CR:Annual Leave of 14 days for each of the first five years and 21 days thereafter.
NW: Annual Leave of 30 days excluding public holidays, weekends and sick leaves if any taken.
CR: Termination notice period is one month for monthly contract employees and 15 days for daily contract employees
NW: Termination notice period is increased to three months and one month respectively.
NW: Indemnity of upto 15 working days for each of the first five years. Indemnity of one month pay for each year after completion of five years provided their total salary does not exceed their salary for an 18 month period On termination from the employer, employees are entitled to full indemnity
CR: On resignation, if it is within the first five years -- no indemnity On resignation, if it is after 5 years -- 1/2 indemnity
NW: On resignation, if it is within the first five years -- half the indemnity On resignation, if it is after 5 years and within 10 years - 2/3 indemnity On resignation, if it is after 10 years -- full indemnity
NW: 3 days holidays for Eid Al-Fitr, 4 days for Eid Al-Adha and one day for Liberation day. These are in addition to other public holidays. Total = 13
CR: Maternity leave of upto 70 days of which 30 should be prior to delivery and 40 days after delivery
NW: No restrictions. 70 days provided and the person can choose as when they need to take the holidays
CR: Termination of services if maternity leave has been extended NW: Maternity leave can be extended upto 4 months without pay and no termination allowed
CR: Breast feeding hours per day is one hour
NW: Breast feeding hours per day is two hours
NW: Muslim women entitled to bereavement leave period of 4 month and 10 days following their husband's death.
CR: Annual pilgrimage leave of 21 days only after completion of three years of service
NW: Annual pilgrimage leave of 21 days only after completion of one year service
NW: Employees working on public holidays need to be paid double pay rate in addition to day off later.
NW: Women cannot be asked to work between 8:00PM and 7:00AM, except health services and other professions exempted by the Ministry of Social Affairs and Labour
NW: Limited period labour contract should not exceed 5 years and should be minimum one year. Employers terminating the contract prematurly should compensate the employee for the remaining contract period.
NW: Employee not reporting for 7 consecutive days or 20 non-consecutive days can be terminated after providing full end of service indemnity
NW: Employees cannot be terminated during their annual leave period.
NW: Monthly pay should be paid in full before 7th of every next month
NW: Minimum wages to be decided for certain categories of employees
NW: Sick leaves entitled to 15 days with full pay, 10 days with 75% pay, 10 days with 50% pay, 10 days with 25% pay and 30 more days without pay. Those with chronic diseases are exempted from these rules
NW: Workers can accumulate the annual leave to be taken in one block for upto 2 years and if the employer agrees this can be taken for more than 2 years.
NW: Employees can claim financial pay for the annual leave period if they did not take the time off.

well these laws are only for goverment sector areas not for private sector areas,would like to knw the private sector laws

Private sector law is easy. WHATEVER THE EMPLOYER WANTS TO DO.
Who is going to the courts to fight against the employer?????
How are they going to implement the new laws when they are struggling (neglecting) to implement the existing laws?

I am graduate engineer on visit visa working in Kuwait for the last two months. With the new labour law,is there a chance of my visa conversion to employment being rejected?
